Code of Criminal Procedure

The Code of Criminal Procedure, 1973 (Cr.P.c.) is a criminal procedural law that enlivens almost all the criminal substantive laws of the land. It lays down procedures to enforce the liabilities and remedies, legislated under criminal substantive laws, through a pre-set legal mechanism. Also, it deals with the creation and regulation of various stakeholders in the criminal justice delivery system such as Public Prosecutors and the hierarchy of Criminal Courts. It is a manifestation of the constitutional guarantees and principles which pervades through the entire criminal justice delivery system. Thereby, it secures the rights of the accused as well as the victim adhering to the principles of fair trial and rule of law. Students while studying and understanding the nuances of the statute must develop a resolve of reading different provisions together to get a clear understanding of the working of our criminal justice delivery system.
